This breaking story has just been released (March 12, 2008) by the Chronicle of Higher Education and notes that Capella University Overcharged Student Lenders $588,000! That's right, Capella and their unethical administrators have been caught violating the law again. As previously reported on this site, Capella University has:

Why are tax payers funding a sleazy operation like Capella "University?" Oh well, as Oaf Offerman stated during his PR stunt with his "Transparency by Design" nonsense, "We have the courage to do the right thing." If that's the case, then why does Capella continually violate Federal laws? We urge the Office of the Inspector General Inspector to throw the book at Capella.

In addition the the media reports regarding Capella University's kickback scam with other schools whereby they're paying $500 for every student that enrolls in their substandard programs (taught by charlatan's such as Diane Stottlemyer who have literally bought and used fake degrees from diploma mills), Capella University dishonest, lying president, Michael Oaf Offerman is also being exposed for the FACT that he, along with his equally sleazy chief shyster, Greg Thom, are the two individuals responsible for Capella University's violation of Federal law.

It also needs to be mentioned that Gary Matkin, the Dean of Continuing Education and Kickback Studies at UC Irvine, along with Robert Dynes, President of the UC System KNEW about Capella's charlatan more than two years ago - and they did NOTHING.

Capella University's unethical practices of paying kickbacks to schools such as the University of California, Irvine (UCI) has been exposed once more – this time by the Los Angeles Times. Not only that, but the Times has also exposed new information about the fact the Capella University has kickback arrangements with two other schools within the University of California system – UC Berkeley and UC Santa Cruz. It appears as if UC Berkeley may have also signed a kickback agreement with Capella but, allegedly, none of UC Berkeley’s students were scammed into transferring into Capella. Not surprisingly, Gary Matkin, the unethical Dean of Continuing Education, just happens to be good buddies with Capella University's equally unethical President and liar, Michael Oaf Offerman, is trying to worm his way out of this scam. According the LA Times,

"Gary Matkin, UCI's dean of continuing education, said the money was used to market students' eligibility to transfer to Capella in the extension program's quarterly catalog, on its website and through letters sent to students. Matkin, who set up the arrangement in 2002, said, 'Everything we did was perfectly legal, straightforward and in the best interests of our students.

'People are misconstruing this as somehow being, if not illegal, unethical, so we're just going to stop.'"

Surely, Gary Matkin is a complete moron if he sees nothing wrong with his school's unholy alliance with Capella University. Of course, Matkin is such a jerk that he tires to hide the FACT that he, UCI's moronic Chancellor, Michael Drake, and the extraordinarily unethical president of the entire UC system, Robert Dynes (you remember him – he;s the one that politicians and members of the public, alike, screamed for his resignation when it had been exposed that Dynes has been living like a king off of taxpayer dollars), all KNEW about the fact that UCI was taking kickbacks, as well as the FACT that the Capella instructor, Diane Stottlemyer, who is at the heart of the lawsuit currently pending against Capella, had bought fake degrees from a diploma mill. As with all dishonest and unethical sleaze bags like Gary Matkin, Michael Drake, Robert Dynes, and Michael Oaf Offerman, they sat around and did NOTHING. Well, that's not exactly true. Gary Matkin is such a dishonest and unethical moron that instead of responding to complaints about the corruption at Capella, he COOPERATED with Capella in their sleazy defense against the student.

Before we continue, we want to point out what the unethical money-mongers from the UC system KNEW about the Capella situation more than two years ago (they've had more than enough advance warning prior to the recent news reports about the unethical Capella-UC kickback scam). Michael Oaf Offerman, Capella’s President and Liar - Oaf Offerman may not officially work for the UC system, he's certainly the first thug that Gary Matkin whines to when UCI students complain about the corruption at Capella. As a result, we're including Offerman in this list because Matkin (and perhaps Dynes and Drake) refused to respond to complaints but had no problem forwarding them onto Capella and their shysters.

Now that we've got that settled, readers will be interested in reading parts of one of the complaints that had been sent off to Dynes and his goons:

"UCI has been receiving money, from Capella University, for marketing their diploma mill. As I mentioned in [an earlier] correspondence to you, the 'instructor' at the heart of [the] lawsuit against Capella literally purchased her 'degrees' from another diploma mill. It is abhorrent to think the University of California, as a respected public institution, is helping to market a for-profit scam like Capella University. Why?"
"Capella University pays UCI for students who enroll and then complete some of their courses at their diploma mill. Why?"
"In light of the fact that at least one of [the] 'instructors' [Diane Stottlemyer] at Capella literally purchased her "graduate degrees" from a diploma mill (Lacrosse University), why does the University of California continue to endorse Capella University?"

Wonder why scumbags Matkin, Drake, and Dynes refused to respond? Obviously, they've not only endorsed the Capella-UC kickback scam for more than two years but also have also endorsed Capella's practice of hiring charlatan's like Diane Stottlemyer.

The Los Angeles Times, like the Chronicle of Higher Education, met with the same kind of moronic excuses from one of Capella University's spokesholes, Michael Walsh. The Times stated that,

"Michael Walsh characterized the referral fees as 'tuition-sharing payments' to offset UCI's costs for marketing his school's programs."

Clearly, Walsh is just another two-faced moron. "Tuition-sharing payments?" Give us a break! Walsh is simply too dishonest to say that Capella University has been paying KICKBACKS! The Times then reported that,

"Capella has 'numerous' credit-transfer programs, mostly with community colleges, Walsh said, but he declined to disclose how many involve per-student payments."

So, spokeshole Walsh, just how many community colleges are receiving kickbacks from Capella? What are you so AFRAID to tell the truth?

The Times shed some new light on other "alliances" that Capella has with other UC schools; the article mentioned a spokeshole from Robert Dynes Office, Chris Harrington, who stated that "[UC] Santa Cruz does not receive payments." Gosh, perhaps Chris Harrington is one of the people from Dynes Office who tries "to get away with as much as possible and disclose as little as possible?'" The Los Angeles Times stated that Ann Guy, a spokeshole from UC Berkeley, (oops, we almost forgot to mention that Gary Matkin worked at UCB before moving on to lead the Kickback Studies programs at UCI) commented that,

"Berkeley also is ending the program because of the public perception of ethical problems, said Ann Guy, spokeswoman for the university's extension program."

Getting back to another one of Gary Matkin the Moron' asinine statements, the Times noted,

"Because it [Capella University] is for-profit, I [Matkin] felt that it was logical for us to seek some sort of compensation for the marketing we are doing for them," Matkin said, "so we asked them to give us money for the number of students that matriculated to them."

Is Matkin REALLY that STUPID? Why of course he is! WHY is a non-profit state school MARKETING for a for-profit scam like Capella University? There is NOTHING logical about that. Oh yeah, we almost forgot, Gary Matkin and Capella’s President, Michael Oaf Offerman are good ‘ole boys.

The Time's article concluded with a real kicker:

"David Hawkins, director of public policy and research for the National Association for College Admission Counseling, in Alexandria, Va., said such arrangements appeared to be in conflict with the association's ethical code, which bars member schools from accepting payments for placing or recruiting students. UCI is not a member, but UC Berkeley is.

'Any time you reduce the basis of recruitment to cash kickbacks or commission sales, the ability and willingness of recruiters to act in the interest of students goes downhill quickly," he said.'"

It should be very evident that Gary Moneybags Matkin, Michael Frankenstein Drake, Robert Dishonest Dynes, and Michael Oaf Offerman all have something other than the interest of students in mind – their own self-centered hides. Frankly, they should all be fired.

Capella University GUILTY!

A Federal Law Enforcement Agency has Just Found Capella University in Violation, on TEN COUNTS, of the Family Educational Rights and Privacy Act (FERPA)!

In yet another secular announcement, within the past two days, the Family Policy Compliance Office (FPCO), a law enforcement agency of the United States Department of Education, has just informed Capella University's lying President, Michael J. Oaf-Offerman (who is also involved in the Capella University - University of California, Irvine kickback scam that was also just reported by the Chronicle of Higher Education) that his "school" has been found in violation, on TEN COUNTS, of the Family Educational Rights and Privacy Act (FERPA) for their intentional refusal to turn over education records of a student who is currently suing them. What makes this even more disgusting is that well over THREE YEARS have already transpired and Capella still hasn't produced those records (and; therefore, the FERPA investigation against them remains open)!

While there is much, much more to this story than we are currently reporting (to be posted in the near future), the FPCO notified Oaf-Offerman in a letter dated September 24, 2007 that there were ten items that the student had request but that Capella has refused to produce for which,

It can't get any plainer that that! Again, will be posting much more on this matter, including the countless number of times that Capella own unethical shysters have stuck their big ~~feet~~ hooves, in their mouths regarding this important case!

It is a FACT that Capella University’s “attorneys” from the “law firm” (we use that term loosely) of Drinker Biddle are liars! For example, shyster Greg Thom and Capella’s incompetent “dean”, Kurt Linberg (the one who is unable to spell even the simplest of words), both promised to provide copies of Capella’s bogus “accessibility study” of WebCT more than three years ago (we’re still waiting for the full and complete “study”). Capella and their shysters continue to refuse to comply with the Family Educational Rights and Privacy Act (FERPA) which requires that they turn over copies of all documents within forty-five (45) days of the initial request – again, more than THREE YEARS have now gone by and they’ve refused to comply. (BTW, there are currently SEVERAL FERPA complaints against Capella University, including the ones just mentioned, that have been filed by more than one student, with the United States Department of Education, Family Policy Compliance Office, at this very moment). We would also like to note that shyster L’Orange was so ignorant of this law that he couldn’t even pronounce the acronym properly during depositions – he referred to it a “FERPRA” [sic]! Then there’s the little matter of the formal demand for production that was made of Capella and their shysters nearly eight months ago, on December 1, 2006. To date, they refused to turn over almost EVERYTHING that was demanded. Obviously, the shyster squad is trying to hide something.

Getting back to the unethical sleaze team from Drinker Biddle & Reath, Shyster Epling first showed her true colors by lying, under penalty of perjury, almost immediately after the lawsuit was filed against Capella University for their retaliation against a student who had the courage to speak up about the gross incompetence of their online course room and incompetent “instructors” (Diane Stottlemyer, Capella’s charlatan who literally bought and used fake degrees from a known diploma mill – Lacrosse “University”). Interestingly, shyster L’Orange has let Capella Stella wear the pants when it comes to filing declarations with the court (which, as already noted, shyster Epling has consistently displayed her inability to tell the truth). That doesn’t mean that shyster L’Orange hasn’t lied – he has, numerous times – he’s just been too much of a girly-man to put things in writing. For example, shyster L’Orange made an agreement at one of his abusive and ill-prepared “depositions” (held more than one year, eight months ago) in which he personally agreed to provide Capella’s bogus “accessibility study” that Capella University’s feeble lying president and oaf, Michael Offerman, publicly pronounced as being "universally praised for being exceptionally user-friendly and intuitive, and providing new and useful online tools." Not only was Offerman’s statement a blatant lie, but shyster L’Orange reneged on his promise to turn that study over. In fact, shysters L’Orange and Epling didn’t bother to turn anything that even remotely resembled that so-called study until just a few months ago - well over a year after he promised he would. Then, the nonsense that shysters L’Orange and Epling finally did provide turned out to be a veritable jumbled mess consisting of over 1,000 “documents” – many of which were single pages. Of course, these were not provided in any type of recognizable order; in fact, materials had been censored (yes, CENSORED); countless graphs, charts, and other materials were spread across countless pages; in other words this so-called “study” is utterly useless in the form that the shysters submitted them. Not only that, but these “documents” are NOT ACCESSIBLE. Rather stupid, to say the least, considering that the lawsuit concerns the intentional refusal of Capella University to accommodate those with genuine disabilities, as required under the Americans with Disabilities Act (and also California’s Unruh Civil Rights Act)! What a bunch of unethical JERKS!

Minnesota's Pioneer Press reported (June 16, 2007) "In rare turnabout, student accuses teacher of plagiarism" regarding the case of student-hero, Mary Swenson, for suing Capella University "instructor" Sharon Bender. The article states that,

Gosh, isn't that nice?! Obviously, Sharon Bender appears to be joining other corrupt and unethical Capella University instructors such as: Diane Stottlemyer (the one who buys and uses bogus degrees from diploma mills), Shawn Ambrose (Capella's head cheerleader who harasses other students), Richard Costello (caught using another employer's computers to "teach" Capella courses), as well as many, many more employees.

The Pioneer Press noted that many other interesting items including Capella University's claims about obtaining accreditation from the American Psychological Association (APA) -

As we have long noted, Capella has been trying, for many years to obtain accreditation from the APA without success. Hopefully, they never will.

interestingly, the article notes that one of Capella's "attorneys" (which must be either shyster Greg Thom or his side-kick, Priscilla McNulty) had the audacity to send a threatening letter to Swenson. Specifically, "the letter also warned that Swenson's 'continual actions in placing blame on others, including claims that everyone from her editor to her mentor to members of the (doctoral) committee changed her work, raise serious issues of academic integrity.'" In light of the blatant lack of integrity that has been so consistently displayed by shyster Greg Thom, as well has the hilarious drivel submitted to the court (concerning another lawsuit against Capella) by Priscilla McNulty, they are the LAST individuals, anywhere, to threaten others regarding the topic "integrity."

Capella University and their Sleaze Team have refused, for THREE YEARS, to turn over education records as required by the Family Educational Rights and Privacy Act (FERPA) - the initial request was made on July 10, 2004. FERPA requires that such records be turned over within forty-five days of the initial request. Just as disgusting is the fact that Sir Chrisy the Sissy (H. Christian L'Orange) and Capella Stella Fey Epling have consistently thrown temper tantrums when they don't get their way. Capella University and some of their esteemed "learners" (Capella-speak for "student") love to toss around the term "rigor" as part of their feeble attempt to describe the Capella experience. Interestingly, we've just come across (March 27, 2007) some very enlightening information published by the United States Department of Education's National Center for Education Statistics regarding the "rigor" of Capella University's admissions process. Before we tell you how difficult it is to enroll in one of Capella's undergraduate programs (their standards are so high that we're confident that these must apply to their graduate programs too), we've created a quick test to determine if you are worthy of becoming a Capella "learner":
